Issue #36 closed with three open questions: would a sixth simultaneous solicitation appear from Kubricky-Jointa Lime, would a third door open on Keese Mills Road or the Albany wharf test, and would a second agency follow OASAS's lead into agency-side doubling? This cycle answered a version of all three — just not the way the streak implied.

James H Maloy, Inc. didn't wait for Kubricky-Jointa Lime to hit six — it matched Kubricky-Jointa Lime's own high-water mark, posting five simultaneous MWBE/SDVOB/DBE subcontractor solicitations across five unrelated scopes in a single two-day window (Albany County Airport Authority's cell phone lot and economy parking lot, the City of Albany's landfill stormwater project, the City of Hudson's Public Square renovation, and — notably — a new door on the Albany Port District wharf test program).

That last one matters twice over. The Albany Port District Wharf Test Program, which CD Perry, LLC posted standalone in Issue #35 and Harrison and Burrowes doubled in Issue #36, just picked up a third prime: James H Maloy, Inc., same deep-foundation testing scope, same August 5 deadline.

Harrison and Burrowes, meanwhile, shows up on a second multi-door project this cycle. The Conklingville Dam Foundation Remediation and Concrete Repair scope in Hadley, Saratoga County — which Kubricky-Jointa Lime posted in Issue #36 — now has three firms running the identical subcontractor solicitation, all due August 19: Kubricky-Jointa Lime, LLC, Harrison and Burrowes Bridge Constructors, Inc., and The Wesson Group.

And the agency-side question is resolved: OPWDD is running the Westfall Campus Bar Screen Building Rehabilitation Project through two simultaneous discretionary lanes at once — an MWBE/SDVOB procurement and a separate NYS Small Business/Recycled Technology procurement, both due August 28. OASAS is no longer the only agency doubling up.

Separately, Vernon Construction & Development LLC is now running its own doubled-up-prime pattern — a new Namm Building perimeter-heating solicitation alongside its Rockland Psychiatric Center nursing-cores pick — while a competing firm, Andron Construction Corp, has opened its own door on that same Rockland PC scope.

On the federal side, the Air Force AFOSH 8(a) listing and FEMA's GPATS BPA both carry forward from Issue #36 and close within the week; a new Total Small Business marketing solicitation for the DC Army National Guard just posted.

One genuinely new listing surfaced this cycle (DCARNG Marketing Services); the rest of the federal lane is carryover from prior issues, all closing within the next three weeks.

Issue #37 draws from NYC PASSPort, the NY State Contract Reporter, and a fresh SAM.gov pull. Key eligibility reminders across all three layers:

NYC contracts require active PASSPort registration and NYC MWBE certification through NYC SBS for MWBE participation goals. Certification must be active — not pending or expired — at the time of submission.

NYS contracts require NYS MWBE certification through Empire State Development (ESD) — which is separate from NYC SBS certification. The MWBE/SDVOB-designated NYSCR contracts in this issue, including James H Maloy's five solicitations, the Albany wharf test's third door, the Conklingville Dam three-door scope, OPWDD's two Westfall Campus lanes, Vernon Construction's two solicitations, Andron Construction, the AED statewide contract, and the SolarWinds renewal, are governed by NYS procurement rules. Confirm which certification layer applies before responding.

Federal contracts do not recognize NYC or NYS MWBE certification. This cycle's SAM.gov listings span Total Small Business, 8(a), and WOSB set-asides — each with its own eligibility requirements (active SAM.gov registration, SBA 8(a) program certification, or SBA WOSB program certification, respectively). SAM.gov registration is mandatory for any federal contract or subcontract pursuit.

Firms that pursue contracts before resolving certification gaps often lose months correcting eligibility issues after deadlines have passed.

Two primes now sit at the same high-water mark. James H Maloy matched Kubricky-Jointa Lime's five-simultaneous-solicitations count this cycle — but did it in a single 48-hour window rather than building up across three issues. Worth watching whether a third prime attempts the same compressed version of the pattern, or whether James H Maloy pushes to six before Kubricky-Jointa Lime does.

Two marquee multi-door projects both grew a third door in the same cycle. The Albany Port District wharf test program (CD Perry → Harrison and Burrowes → James H Maloy) and the Conklingville Dam foundation remediation scope (Kubricky-Jointa Lime → Harrison and Burrowes → The Wesson Group) both went from two firms to three. Harrison and Burrowes now sits on both. If either project draws a fourth door, or if Harrison and Burrowes appears on a third multi-door project, that's a materially different pattern than what we've tracked to date.

The agency-side doubling pattern confirmed itself. OASAS was the first; OPWDD is the second, running its own two-lane discretionary split (MWBE/SDVOB vs. NYS Small Business) on the identical Westfall Campus project. Two agencies in two consecutive issues suggests this is a structural feature of how NYS agencies are splitting discretionary awards, not a one-off. We're watching for a third.

A new doubled-up prime appeared with a rival attached. Vernon Construction is now running two unrelated scopes at once, while a separate firm (Andron Construction Corp) opened a competing door on Vernon's original standalone pick from Issue #36. That combination — one prime doubling up while also facing new competition on its earlier scope — hasn't shown up together before.
