📋 WHAT'S IN THIS ISSUE

Issue #38 closed with a new and sharper pattern: Lanmark Group, Inc. — already tracked for running MBE/WBE/SDVOB subcontractor solicitations across unrelated DASNY and DDC projects — had opened a competing door on Vernon Construction & Development LLC's own Namm Building pick. We closed that issue by asking whether the behavior would become reciprocal.

It did — on a different project, from a different firm, two days later.

CUBE Construction Services LLC posted its own subcontractor solicitation for the DDC Washington Irving Branch Library Renovation — the exact scope Lanmark itself posted August 10 (CR#2137928, due August 26). CUBE's door (CR#2138025) is due on the same August 26 date. Lanmark, the firm that spent two issues opening doors on other primes' picks, now has one opened on its own.

Separately, SUNY ESF's Illick Hall & Baker Hall West Wing renovation — already a two-door project as of Issue #38 (Bette & Cring, LLC vs. Bellows Construction Specialties, LLC) — grew a third: Northland Associates, Inc. posted its own MWBE/SDVOB solicitation for the identical scope (CR#2138051, issued August 13, due August 26, same as the other two). Northland is also the firm behind the still-unresolved Kunsela Hall listing from Issue #38 — meaning Northland is now running two simultaneous solicitations of its own, on two different SUNY campuses.

On the Namm Building thread: Vernon Construction's original door (CR#2137600) closes today, August 17; Lanmark's competing door (CR#2137926) remains open through August 20. No third firm has entered.

The Kunsela Hall duplicate flagged in Issue #38 — Northland Associates ("Utica, NY") vs. Beebe Construction Services via SUCF ("Marcy, NY") — remains unresolved, with no new posting to clarify it this cycle.

On the federal side, this cycle's SAM.gov pull returned a notably narrower lane: every listing retrieved this cycle carries a Total Small Business Set-Aside (FAR 19.5) — no 8(a) or WOSB set-asides surfaced. The Army's NJ/NY recruiting-station graphic upgrades listing, flagged in Issue #38 with an August 18 deadline, has been extended again — now due September 2, continuing the extension pattern we flagged in the last issue. FEMA's GPATS BPA closed as scheduled on August 13.

⚠️ IMPORTANT MWBE PROCUREMENT NOTE

Issue #39 draws from NYC PASSPort, the NY State Contract Reporter, and a fresh SAM.gov pull. Key eligibility reminders across all three layers:

NYC contracts require active PASSPort registration and NYC MWBE certification through NYC SBS for MWBE participation goals. Certification must be active — not pending or expired — at the time of submission.

NYS contracts require NYS MWBE certification through Empire State Development (ESD) — which is separate from NYC SBS certification. The MWBE/SDVOB-designated NYSCR contracts in this issue, including the Washington Irving two-door project, the SUNY ESF three-door project, the Namm Building second door, Northland Associates' two simultaneous solicitations, and KITEWORKS SOLUTIONS, are governed by NYS procurement rules. Confirm which certification layer applies before responding.

Federal contracts do not recognize NYC or NYS MWBE certification. This cycle's SAM.gov listings are exclusively Total Small Business Set-Asides — active SAM.gov registration is mandatory for any federal contract or subcontract pursuit. Two of the four listings this cycle (TEPS III) are further restricted to existing DOE/NNSA TEPS III BPA holders.

📈 WHAT WE'RE TRACKING NEXT

The reciprocity question from Issue #38 is answered. Lanmark Group opened a door on Vernon Construction's Namm Building pick last cycle. This cycle, CUBE Construction Services opened a door on Lanmark's own Washington Irving Branch Library pick — two days after Lanmark posted it, same August 26 deadline. This confirms the multi-door pattern now runs in both directions: a tracked multi-prime firm is not immune from the same treatment it hands out.

SUNY ESF's Illick Hall/Baker Hall renovation grew from two doors to three in a single cycle. Northland Associates joined Bette & Cring and Bellows Construction Specialties, all due August 26. This is the fastest escalation of a multi-door project we've tracked — worth watching whether a fourth door appears before the deadline.

Northland Associates now shows the early shape of a second multi-prime pattern. Between the unresolved Kunsela Hall duplicate and the new Illick Hall/Baker Hall door, Northland has two simultaneous SUNY solicitations open this cycle — echoing, on a smaller scale, the pattern we first flagged with Lanmark in Issue #35.

Namm Building's outcome is close. Vernon's original door closes today; Lanmark's remains open three more days. No third firm entered either side this cycle — worth checking whether that holds through August 20.

The federal lane narrowed to a single set-aside type. Every listing in this cycle's SAM.gov pull carries a Total Small Business Set-Aside — no 8(a) or WOSB notices surfaced, a shift from Issue #38's mixed lane. Worth watching whether that's a pull artifact or a genuine narrowing.
